Use of the lease

This model allows you to rent a parking space or garage detached from a dwelling. We have created alternative versions of this rental agreement to suit different situations. One version allows you to split the rental of a parking space, i.e. to rent a space to two tenants at the same time. Another model is dedicated to cellars, boxes and garages used for furniture storage. It is very important to use a dedicated contract for a storage activity. The last type is used forvehicle winter storage, to better protect the lessor.

In practice, how to use this lease

The rental lease makes it possible to contractualize the conditions of provision of a parking space. It protects the tenant as well as the landlord. The rental of a parking space, garage or box depends directly on the civil code. It is not a legal obligation to sign a rental contract for a parking space, although it is strongly recommended.

💡 Did you know : A prospective tenant who refuses to sign a rental agreement is someone who will cause you problems.
It is better to refuse a rental than to risk renting without a contract.

Contract duration

The term of the lease for a car park, garage or lock-up is flexible. You can sign a short lease that is tacitly renewable, or even an open-ended contract with no end date. The open-ended contract is used by some club members, although it is preferable to set an end date.

The rental period in our lease model ensures that the tenancy is secure. The contract cannot be terminated before it is tacitly renewed for a legitimate and serious reason. For the tenant, this could be in the event of death, loss of employment or moving house. For the landlord, it is the tenant’s failure to meet his obligations that will enable him to terminate the contract ipso jure, including, of course, non-payment of rent.

If the lease is tacitly renewable, both parties are free to terminate it, subject to the notice period specified in the contract. We recommend that you give at least 1 month’s notice.

How do you set the rent ?

The rent is set freely between the parties. Rent controls in some French towns and cities do not apply to parking spaces and garages when they are detached from a dwelling. Our market research simulator can help you determine the best rent in your area.

You can recover the charges on a flat-rate or actual basis. In the latter case, the amount of the provision for charges can be set out separately in the tenancy agreement, and will be adjusted upwards or downwards at the end of the year. It is preferable to underestimate the amount of the service charges, and it is up to you to regularise them in addition at the end of the year or to give the difference to your tenant as a gift.

Rent increase

You can revise the rent each year in line with changes in an country index. For example, in France, you can use the rent reference index (IRL) or the cost of construction index (ICC). It is very important to enter the value of the index for the quarter in which you sign the tenancy agreement. In general, we recommend that you use the construction cost index, which increases more than the rent reference index.

Explain each clause of the contract to your tenant

It is very important to explain each clause of the lease to your tenant. Take the time to read the entire rental agreement for your future tenant. The civil code provides for the partial or total cancellation of a contract if one of the two parties demonstrates a lack of understanding. The reading of the lease also allows to insist on the clauses concerning the delay of payment.

Pre-fill the lease to save time

Take the time to pre-fill out the rental agreement. The landlord section includes your contact information, you can also fill in the location designation section. The ideal is also to prepare the lease with the contact information of the future tenant, this tip helps the person to project himself.

Take stock of the complementary parts

The future tenant is interested in your location. You only have to give him the list of documents to provide to establish the rental contract. You can include the employer’s certificate in the documents to be provided.

A bad payer always finds a good excuse. If your future tenant is unable to provide the certificate, don’t feel bad and find another tenant!
